All data inputted in EZYcount service is your property. You have the right to read it, manage it, delete it and share it. If for any reason, you want to delete your data, you can do this directly in EZYcount services by deleting your account.

Applicable law

The processing of Swiss customer data is governed exclusively by Swiss law, in particular by the Federal Data Protection Act (DPA, SR 235.1) and the Ordinance on the Federal Data Protection Act (SR 235.11). The EU General Data Protection Regulation (GDPR) is not applicable. The GDPR remains applicable (i) if it is expressly provided for certain areas of this Privacy Policy and (ii) if its application is mandatory for Swiss Customer data due to special circumstances.

Log data

We may collect information that your browser sends whenever you visit our Service ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

Cookies

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our services for you. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.

We reserve the right to modify or replace these terms at any time. We will do so to improve the service and continue to develop the technology used by EZYcount.

Data security

The Supplier takes technical and organizational security measures in accordance with recognized industry standards in order to protect the personal data it collects against unintentional, illegal or unauthorized manipulation, deletion, alteration, access, transmission or use, and in order to prevent any partial or complete loss of such data. The Supplier's servers are located in Switzerland and Europe. Certain services may be processed via servers located in other countries with an appropriate level of data protection. The connection to the Supplier's servers is secured by SSL encryption. The Supplier regularly backs up Customer data. The Supplier's security measures are continually updated and strengthened in line with technological developments. The Supplier declines all responsibility in the event of loss of data or consultation and use of data by third parties. The Supplier cannot guarantee the security of data transmissions over the Internet. In particular, the transmission of data by e-mail entails a risk of intrusion by third parties. Access is nevertheless protected using the HTTPS protocol.

Your use of the service is at your own risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. EZYcount do not warrant that the website or service will function uninterrupted, securely or available at any time or location, any errors can be detected, and that the website will always be free of viruses and other harmful components.

Right of access, right of rectification, right of deletion, right of objection, consent

With regard to personal data, Customers have the following rights in accordance with the DPA and the RGPD. In principle, the Supplier also grants Swiss Customers the rights provided for in the RGPD. However, the Supplier reserves the right to make a different assessment in specific situations.

right of access (art. 8 LPD, art. 15 RGPD);
right of rectification (art. 5 par. 2 LPD, art. 16 RGPD);
right of deletion (art. 17 RGPD);
right to limit processing (art. 18 RGPD);
right of portability (art. 20 RGPD);
right to object (art. 21 RGPD).
The aforementioned rights are subject to any restrictions of the RGPD as well as the respective applicable national laws, whether or not they relate to data protection.

In connection with the provision of the services offered by the Supplier, the Customer is invited to give his consent to the collection, processing, transmission and use of his personal data by the Supplier by ticking the relevant box.

The Customer may, of course, withdraw his consent at any time without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal thereof. A request for withdrawal may be sent in writing to the Supplier's address mentioned above, or by e-mail to support@ezycount.ch. In this case, the

Right of recourse

If the Customer believes that the processing of personal data concerning him violates the provisions of the RGPD, he may lodge a complaint with a supervisory authority in accordance with Article 77 of the RGPD.

The Supplier is of course willing to take cognizance of the Customer's questions and wishes before launching a formal procedure. The Customer may contact the Supplier in writing or by e-mail (support@ezycount.ch).
